10-YEAR LIMITED WARRANTY & CLAIMS
You must submit a warranty registration for each HydroTech product within 30 days after purchase either (a) online at https://hydrotechproducts.com/pages/warranty-claims, (b) by mail at 30339 Diamond Parkway, Suite 105, Cleveland, OH 44139 or (c) by calling 1-844-430-1311. Registration is a condition precedent to warranty coverage, and failure to submit a completed warranty registration will invalidate this Limited Warranty.
Winston Products, LLC (“Winston”) extends a limited warranty (this “Warranty”) that the HydroTech branded product (the “Product”) is free of defects in materials and workmanship for a period of ten (10) years from the date of retail purchase by the original consumer of the Product (the "Original Consumer").
Who is Covered:
This Warranty extends to only the Original Consumer. Subsequent owners or users of the Product are not covered under this Warranty.
Winston will provide the following remedies in the sequence provided to whatever extent it shall deem necessary to satisfy a proper claim under this Warranty:
First, provide the necessary replacement parts free charge for the Original Consumer to complete the repair and restore the Product to its proper operating condition.
Second, if after a reasonable number of the repair efforts are unsuccessful, then one of the two following remedies at the option of Winston:
- Replace the Product with a direct replacement or with a similar product of equal value deemed by Winston to perform substantially the same function as the original Product; or
- Refund the original purchase price of the Product (note: the Original Consumer must be able to present the original receipt of purchase or other satisfactory proof of purchase).
REPAIR, REPLACEMENT, OR REFUND OF THE PURCHASE PRICE ARE THE EXCLUSIVE REMEDIES OF THE PURCHASER AND THE SOLE LIABILITY OF WINSTON UNDER THIS WARRANTY. NO EMPLOYEE OR REPRESENTATIVE OF WINSTON IS AUTHORIZED TO MAKE ANY ADDITIONAL WARRANTY OR ANY MODIFICATION TO THIS WARRANTY WHICH MAY BE BINDING UPON WINSTON. ACCORDINGLY, PURCHASER SHOULD NOT RELY UPON ANY ADDITIONAL STATEMENTS MADE BY ANY EMPLOYEE OR REPRESENTATIVE OF WINSTON.
What is Not Covered:
This Warranty does not cover product or equipment damaged due to misuse, abuse, or accident, including, but in no way limited to: (a) deterioration from wear or exposure; (b) improper maintenance; (c) failure to follow operating instructions; (d) cosmetic changes that do not affect performance; (e) improper installation; (f) improper or unauthorized repair or modification; or (g) “acts of God” or other contingencies beyond the control of Winston.
Limitation of Liability:
Winston shall not be liable or assume responsibility for loss of time, loss or damage to personal property, expenses, or any other incidental or consequential damages incurred as a result of or in connection with the use or ownership of the Product.
Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you. This Warranty gives you specific legal rights, and you may also have other rights which vary from state to state.
